Santo Domigo.– The Presidency of Haiti described as unfair the allegations linking the neighboring country's president Michel Martelly to alleged acts of corruption involving San Juan de la Maguana Senator Felix Bautista.
Through Martelly's Twitter account the Haitian Presidency categorically rejected the allegations against the head of state, who has "been linked to a corruption case involving companies or individuals from the Dominican Republic."
Dominican prosecutors said Monday they are investigating allegations of
corruption against Bautista whose companies won millions
of dollars in construction contracts following
the 2010 earthquake in Haiti.
The
investigation comes right after investigative journalist Nuria Piera aired a
story called "Path of Millions" including spreadsheets allegedly compiled from
bank and property records that showed Bautista’s companies had given US$2.5 million to

Last week leading PLD members rallied to defend their party's organizational secretary, senator Felix Bautista against accusations of corruption involving work by his construction companies in Haiti. Bautista was a struggling tailor in his hometown San Juan de la Maguana before the election of President Leonel Fernandez. His close ties to the President have led him on a meteoric rise to become one of the country's leading builders. He directed the Supervisory Office of Public Works of the Presidency (OISOE) for several years, a post he left when he won the senator seat for San Juan de la Maguana, which grants him privileged judicial status.
Leading PLD figures say the media reports are but a desperate reaction of the PRD to garner votes for former President Hipolito Mejia.

The Felix Bautista scandal has already led to the resignation of Haitian Prime Minister Garry Conille, who had begun investigating the award of US$350 million in contracts to Dominican companies. The Miami Herald reports that Conille and Martelly were at loggerheads over issues of the nationality status of government officials - including the fact that Martelly himself has a US passport n and an investigation of US$300 million in post-earthquake contracts and who controls government ministers.
DR Prosecutor General Radhames Jimenez has asked the PRD opposition party and news media to come forward with proof of possible criminal behavior by the senator to investigate the case.

Piera says that since the beneficiary Hadom company had begun operating on 4 April 2011, it was ineligible to legally receive any contracts from the Haitian state following the 2010 earthquake. Dominican Emergency Law, which allows a company to receive contracts without a tender requires a minimum five years of existence for the company to benefit. Hadom received contracts signed by former Prime Minister and current presidential advisor Jean-Max Bellerive for US$1.8 million on 8 November 2010. Bellerive has defended the legality of the transactions given the emergency situation in Haiti. He also highlights in a letter that the funds were not released until the start of the Martelly government.

Manigat said she received campaign contributions from various sources, but always told her team not to accept suspect campaign funds.
Haiti’s National Palace issued a statement saying it “rejects categorically the allegations that the President of the Republic, Mr. Michel Joseph Martelly, has been involved in any corruption case involving firms or individuals from the Dominican Republic.”
The palace called the accusations a “media lynching” designed “to sully the image of President Martelly and undermine” his integrity.
Bautista did not return calls on Monday. But he has denied any wrongdoing. In interviews with Dominican newspapers, he said the contracts were awarded legally.
In an effort to clear his name, he met with prosecutors last week and asked for an investigation into the corruption claims.

Outgoing Haiti Prime Minister Garry Conille had called for an audit of the contracts won by the Dominican companies.
Bautista has claimed principal ownership of Hadom and Roffy, S.A., the two Dominican firms at the center of the contract inquiry in Haiti.
According to Haitian officials, Hadom was only incorporated as a Haitian firm on July 2010, and was awarded a contract four months later. Among its contracts: $33 million to construct a new parliament building.
Roffy, meanwhile, was awarded $174 million to construct the Fort National housing project.
The contracts were awarded by former Prime Minister Jean-Max Bellerive, who defended his right to use Haiti’s 18-month post-quake emergency law to award no-bid contracts.
Bellerive said the principals he dealt with from the Dominican firms were all different, and he denied knowing that Bautista was a shareholder.

Martelly met last week with Fernández during an official visit in which he received a cross under the Order of Merit of Duarte, Sanchez and Mella, the highest honor for a foreign chief of state.
At the meeting, both presidents signed seven agreements, dealing with matters ranging from collaboration on higher education to security along the border that divides the island of Hispaniola, which the countries share.

Felix Bautista denies accusations re Martelly
Senator Felix Bautista is denying the recent accusations that he financed Haitian President Michel Martelly's election campaign, or that he ever gave him money, and said that he had all the documentation necessary to prove that the accusations against him, made in the program Nuria on Channel 9, and other media, were false, and formed part of a defamatory campaign.
He warned that when the time was right he would take legal action against those responsible and that a team of lawyers were currently studying all the information including videos, documents, interviews and commentaries made by several media outlets in order to take the appropriate action.
He went on to quote from the Bible, Chapter three, verses 1-9 of the book of Ecclesiastes, "everything has its time", and said that for now he was concentrating on the election campaign.
Investigative journalist Nuria Piera in turn responded on a TV interview.

Felix Bautista scandal gathers heat
Last week leading PLD members rallied to defend their party's organizational secretary, senator Felix Bautista against accusations of corruption involving work by his construction companies in Haiti. Bautista was a struggling tailor in his hometown San Juan de la Maguana before the election of President Leonel Fernandez. His close ties to the President have led him on a meteoric rise to become one of the country's leading builders. He directed the Supervisory Office of Public Works of the Presidency (OISOE) for several years, a post he left when he won the senator seat for San Juan de la Maguana, which grants him privileged judicial status.
Leading PLD figures say the media reports are but a desperate reaction of the PRD to garner votes for former President Hipolito Mejia.

The Felix Bautista scandal has already led to the resignation of Haitian Prime Minister Garry Conille, who had begun investigating the award of US$350 million in contracts to Dominican companies. The Miami Herald reports that Conille and Martelly were at loggerheads over issues of the nationality status of government officials - including the fact that Martelly himself has a US passport n and an investigation of US$300 million in post-earthquake contracts and who controls government ministers.
DR Prosecutor General Radhames Jimenez has asked the PRD opposition party and news media to come forward with proof of possible criminal behavior by the senator to investigate the case.
On Saturday, investigative journalist Nuria Piera released leads of possible clear proof of trafficking of influence.

Piera says that since the beneficiary Hadom company had begun operating on 4 April 2011, it was ineligible to legally receive any contracts from the Haitian state following the 2010 earthquake. Dominican Emergency Law, which allows a company to receive contracts without a tender requires a minimum five years of existence for the company to benefit. Hadom received contracts signed by former Prime Minister and current presidential advisor Jean-Max Bellerive for US$1.8 million on 8 November 2010. Bellerive has defended the legality of the transactions given the emergency situation in Haiti. He also highlights in a letter that the funds were not released until the start of the Martelly government.

The National Directorate of Prosecution of Administrative Corruption told The Miami Herald that Félix Bautista, a senator from San Juan with alleged ties to Haitian President Michel Martelly, is under investigation. He also is a close ally of Dominican President Leonel Fernández.

Bautista is accused of wielding his influence to win contracts for lucrative construction projects in Haiti, totaling more than $200 million, even though they did not meet the country’s procurement rules.
Those accusations took on new life Monday after Nuria Piera, a Dominican investigative journalist, produced spreadsheets allegedly compiled from bank records that showed Bautista’s companies had given $2.5 million to Martelly, both before and after he won the presidency last year.
In her report, Piera said Hadom, one of Bautista’s companies, won contracts worth millions in Haiti. “Now we realize why,’’ she said.
She also showed documents revealing that on Nov. 5, 2011, Martelly, who was already in office, received $150,000 from Hadom.
The report, which focused on the months leading up to Haiti’s presidential runoff, also said Bautista gave a $250,000 campaign contribution to former presidential candidate Mirlande Manigat on Feb. 18, 2011.

Haiti’s National Palace issued a statement saying it “rejects categorically the allegations that the President of the Republic, Mr. Michel Joseph Martelly, has been involved in any corruption case involving firms or individuals from the Dominican Republic.”
The palace called the accusations a “media lynching” designed “to sully the image of President Martelly and undermine” his integrity.
Bautista did not return calls on Monday. But he has denied any wrongdoing. In interviews with Dominican newspapers, he said the contracts were awarded legally.
In an effort to clear his name, he met with prosecutors last week and asked for an investigation into the corruption claims.
On Monday, Haitian lawmaker Tholbert Alexis told a local radio station, Scoop FM, that he plans to mount a commission to look into the allegations.

Outgoing Haiti Prime Minister Garry Conille had called for an audit of the contracts won by the Dominican companies.
Bautista has claimed principal ownership of Hadom and Roffy, S.A., the two Dominican firms at the center of the contract inquiry in Haiti.
According to Haitian officials, Hadom was only incorporated as a Haitian firm on July 2010, and was awarded a contract four months later. Among its contracts: $33 million to construct a new parliament building.
Roffy, meanwhile, was awarded $174 million to construct the Fort National housing project.
The contracts were awarded by former Prime Minister Jean-Max Bellerive, who defended his right to use Haiti’s 18-month post-quake emergency law to award no-bid contracts.
Bellerive said the principals he dealt with from the Dominican firms were all different, and he denied knowing that Bautista was a shareholder.

Martelly met last week with Fernández during an official visit in which he received a cross under the Order of Merit of Duarte, Sanchez and Mella, the highest honor for a foreign chief of state.
At the meeting, both presidents signed seven agreements, dealing with matters ranging from collaboration on higher education to security along the border that divides the island of Hispaniola, which the countries share.

Felix Bautista denies accusations re Martelly
Senator Felix Bautista is denying the recent accusations that he financed Haitian President Michel Martelly's election campaign, or that he ever gave him money, and said that he had all the documentation necessary to prove that the accusations against him, made in the program Nuria on Channel 9, and other media, were false, and formed part of a defamatory campaign.
He warned that when the time was right he would take legal action against those responsible and that a team of lawyers were currently studying all the information including videos, documents, interviews and commentaries made by several media outlets in order to take the appropriate action.
He went on to quote from the Bible, Chapter three, verses 1-9 of the book of Ecclesiastes, "everything has its time", and said that for now he was concentrating on the election campaign.
Investigative journalist Nuria Piera in turn responded on a TV interview.

"It is natural that the Haitian government says no, I could not expect the opposite," Nuria Piera added on Telenoticias Channel 11 TV program. She recalled that in the Watergate affair, in the US, the authorities spent much time contradicting the results of the investigation by Bob Woodward and Carl Bernstein.
Piera noted that so far there have been only words on the part of the parties concerned while what she did was "an investigative piece of work, about what happened in the countries (Dominican Republic) and how it has had an impact in Haiti because the Haitian president is involved, so pathetic."
Piera finds it particularly difficult to understand why Martelly continued to receive money after his accession to the presidency of Haiti. Otherwise, she explains, this would simply be a case where a Dominican politician, Felix Bautista, is supporting a Haitian politician.
