Superior Administrative Court rules against Ministry of Tourism in Cabarete land dispute

Puerto Plata.- The Superior Administrative Court has issued three rulings in favor of the companies Costa Canal and Calpe, SRL, ordering the Ministry of Tourism (Mitur) and other state agencies to stop interfering with private lands in Cabarete, Puerto Plata. The dispute concerns a public project aimed at improving access to Playa Encuentro, which the companies argue violates their property rights.

The companies claim that authorities destroyed fences made of concrete and barbed wire to ease access to the beach. The first ruling, issued on October 30, 2024, was followed by a second on November 13, which ordered the immediate cessation of intrusions and the removal of unauthorized signs.

The third ruling, issued on December 6 by the Second Chamber of the Superior Administrative Court, imposed a daily fine of RD$4,000 on Mitur and Politur for continuing to violate the companies’ property rights.
