Constitutional Tribunal warns about forced retirements

Santo Domingo.– Submitting a person to criminal processes or disciplinary processes, or twice convicting the person for the same incident, is an injustice and an act of arbitrariness, which is intolerable in a democratic and social state of law, the Constitutional Tribunal (TC) warned the National Police.
As published today in Diario Libre, regarding the Dominican Army the TC said that Law Num. 873 – 78, the Organic Law of the Armed Forces, is clear in relation to the requirements for retiring one of its members.
According to the newspaper, by sentence TC/0375/14 the court confirmed the decision Num. 122 – 2013 dictated by the Second Chamber of the Superior Administrative Tribunal, on 1 May 2013, which orders the National Police chief to restore Ramon Antonio Rodriguez to the rank of sergeant major with all his attributes and rights acquired.
The negative by the police institution to integrate Rodriguez, despite having been previously punished, constitutes an arbitrary measure which has as a consequence a violation of the right to work and his honor, the court.
