Court postpones hearing in ex Public Works chief’s embezzlement case

Santo Domingo.- The Supreme Court 2nd Chamber on Tuesday postponed the hearing on a challenge against the ruling to annul and suppress the investigation into alleged embezzlement against former Public Works minister Victor Diaz Rua.

The decision by Justices Miriam German, Frank Soto and Esther Agelán came after the Justice First Foundation, acting as plaintiff, motion for the judges to recuse themselves.

The justices postponed the proceedings until the full Supreme Court rules on the challenge by Foundation attorney Miguel Surun, who questioned the justices’ alleged partiality.

National District prosecutor Yeni Berenice Reynoso disagreed with the challenge against the justices Agelán, Soto, Alejandro Moscoso and Juan H. Reyes.

During the hearing Reynoso said the case must be heard. "This case file was submitted more than five months ago and has yet to be heard. It’s an investigation that is nearly complete and the prosecution expects to reiterate lawfully, there’s no legal way to uphold this ruling."
