Supreme Court dismisses challenge to coal plant tender

Santo Domingo.- The Supreme Court of Justice (SCJ) has rejected an appeal for alleged anomalies in the tender for the constructionof two coal-fired power plants in Punta Catalina in the southwest, presented bythe Gezhouba Group Company Limited CGGC and the Consortium IMPE CxA, againstthe Dominican Public Electricity Corporation (CDEEE).

The high court decision also favored the Odebrecht Tecnimont constructioncompany, the General Directorate of Public Contracting and the administrativeattorney general.

The companies that submitted the appeal after the CDEE awarded the tenderfor the construction to Odebrecht and Estrella, described it as a flagrantviolation of laws 340 and 543, until it reached the Supreme Court, which ruledin favor of the CDEEE.

The companies claim that they had made a better offer than Odebrecht,which responded by saying that the competing companies had not attained the 40points needed for constructing the two power generation plants.
