Cana Bay owners denounce property rights violations
Punta Cana.- Over 300 property owners at Cana Bay Resort in Punta Cana have denounced ongoing abuses by the resort’s administration, alleging violations of their property rights and threats to the legal security of their investments. Their main grievances include restricted access to their properties, pressure to sign a so-called “Protective Regulation,” and retaliatory measures against those who refuse to comply.
One landowner successfully filed a legal appeal, resulting in a court ruling from the Second Chamber of the Land Court of La Altagracia that ordered the administration to lift access restrictions and imposed daily fines for noncompliance. Despite this decision, property owners report that the restrictive and retaliatory practices persist.
The group warns that these actions jeopardize investor confidence, particularly among foreigners, and express concern that the project was promoted publicly in 2023 with President Luis Abinader present—potentially giving the appearance of legitimacy to what they consider serious legal violations. They are calling for urgent action from the authorities to resolve the situation.
















Gated community and/or resort community investors are promised the moon, i.e., pool privileges, beach parking, beach club, restaurant discounts, and ect. to be enjoyed at private companies, all confirmed by the glib tongues of community developers, promotors, administrators, sellers, and or their agents. However, in many situations what the seller promised is not delivered. When a purchase and sale contract is offered the promises should be included in the document. When a contracted promise is not complied with, it is a breach of contract and could make the seller(s) liable. Buyers should always save dated copies of the original property promotion fliers or even better make the flier information part of the contract. If seller refuses, back off.
In some situations what usually happens in the RD, after most properties within the communities are sold or leased, the sellers change their business identities or unload their investments, while in the same course of actions they will change ownership titles of common properties. There is nobody to bring suit against. Original contract promises are supposedly no longer valid, lost in a tangle of paper.
These unfulfilled promises should be regulated and enforceable.

I purchased in canarock in particular the universe project. I purchased in 2022 with a delivery date of 2024 and they haven’t even started my building yet. They are now ignoring owners with no alternative. I would stay away, I’m currently trying to work with an attorney to find a solution to this mess. I followed the contract and paid the %50 percent of the purchase price. Hopefully I can get my money back since I doubt this project will ever be completed.

before you sign in whatever document is , you should get your personal indipendent lawyer, not just that offered by the seller…
