ACOPROVI backs revised rental and eviction law

Santo Domingo.- The Dominican Association of Housing Builders and Developers (ACOPROVI) has expressed strong support for the newly revised Law on Real Estate Rentals and Evictions, following the incorporation of key recommendations the organization submitted to the Chamber of Deputies on July 3.

In a formal statement, ACOPROVI praised lawmakers for embracing proposals that aim to create a more balanced, transparent, and investment-friendly rental market. The association highlighted that the revised law promotes contractual fairness, legal certainty, and regulatory modernization, aligning the country’s housing legislation with regional best practices.

Key adjustments that earned ACOPROVI’s endorsement include:

  • Elimination of mandatory pre-trial conciliation, which simplifies legal processes and avoids unnecessary delays.

  • Clarification on rent increases, limiting the 10% cap to cases where no specific clause is agreed upon, thus upholding contractual autonomy.

  • Removal of the mandatory purchase option for tenants, ensuring property owners retain full rights to manage or sell their assets.

  • Alignment of sanctions with the Public Force Law, for legal clarity in eviction enforcement.

  • A 15-business-day appeal deadline for housing rulings, improving procedural efficiency and certainty.

ACOPROVI emphasized that these changes represent a legislative step forward, contributing to a predictable environment that encourages investment in residential leasing.
