Rafael Alburquerque warns employers exploiting Haitian workers to avoid payments

Santo Domingo.- Labor law expert and former Vice President Rafael Alburquerque condemned the actions of certain Dominican employers who, according to him, exploit Haitian workers and later request their deportation to avoid paying labor benefits. Speaking on the program Esto no tiene nombre, he described this as an abusive and illegal practice that harms both workers and the country’s international image.

Alburquerque explained that the 80-20 rule in Dominican labor law—which mandates that at least 80% of a company’s workforce be Dominican—remains in effect, though exceptions can be granted for sectors like construction or agriculture. He suggested that the process for granting such exceptions should be handled by the Ministry of Labor, in coordination with employers, unions, and the National Migration Institute, rather than solely by the President.

He also urged the government to strengthen oversight to ensure that employers fulfill their obligations toward foreign workers, warning that neglecting these responsibilities could lead to international complaints. Alburquerque emphasized that the hiring of Haitian labor must be based on legality, respect, and accountability to protect both national interests and human rights.
