US Court dismisses MiaCargo’s million-dollar lawsuit

United States.- The Federal District Court of South Florida has delivered a verdict rejecting the claims made by the international courier company, MiaCargo, against the Dominican Postal Institute (Inposdom) in a lawsuit dating back to 2022. This decision was announced by the Legal Consulting Office of the Executive Branch on March 28, 2024.

According to the report, the court upheld the defense’s arguments, leading to the dismissal of MiaCargo’s lawsuit, which was filed on June 14, 2022, seeking $10 million for an alleged breach of an exclusivity contract.

Legal consultant of the Executive Branch, Antoliano Peralta Romero, confirmed the information, highlighting the collaborative efforts with Inposdom’s defense team, which included representation from Raúl B. Mañón and José Ricardo Feris from the international law firm Squire Patton Boggs, along with their Legal Department.

Following nearly two years of legal proceedings, the federal court sided with the Dominican defense, rejecting the validity of the purported contract between MiaCargo and Inposdom. It was declared that the former director of Inposdom, Adán Peguero, had overstepped his authority by signing the contract without proper authorization.

Inposdom had previously suspended its contractual relations with MiaCargo by the end of 2021, citing various reasons outlined in resolution no. 001-11-021.

The court’s ruling dismissed all claims made by MiaCargo, showcasing the commitment to legality and transparency within the Dominican State.
